6.5 Multi-file Sales/Usage Reports relating to the same transaction

In some cases, the bilateral agreement between the licensee and the licensor may require the licensee to send more than one Sales/Usage Report in respect of the same sales and/or usage data. Examples of this are:

  • The licensor wishes to receive summary Records data (perhaps for high-level market analysis) separately from the detailed sales and/or usage Records (for matching and royalty calculation) in separate Sales/Usage Reports;

  • The licensee may offer both streaming and downloading in the same service but the licensor needs to receive streaming sales and/or usage data in one Sales/Usage Report and download sales and/or usage data in another Sales/Usage Report; and

  • A musical work used in a single transaction may have two or more licensors all of whom use the same service company to process the Sales/Usage Reports and the licensee is required to send as many Sales/Usage Reports to the same service company for each of the licensors with an interest in the musical work.

In these types of cases each of these Sales/Usage Reports are considered independent from each other and shall each be communicated in accordance with the choreography defined in Clause 5.
